ORDER TERMS

INFORMATION FOR THE CUSTOMER, TERMS AND USING CONDITIONS.

1. FIELD OF APPLICATION

Terms of the contract hereby detailed will be applied only to sales contracts with buyers and to all orders sent  through the website riobijoux.com. Placing an order implies that these terms of contract are accepted. Possible changes of the terms of contract will be valid only if confirmed in writing by riobijoux.com. This disposition will be applied even in case of changes to this clause requiring the written form. The sale contract of products through our website is ruled by the Legislative Decree 206/2005, Legislative Decree n. 70/2003 and Legislative Decree n.185/1999, as well as by the following  changes, under the rules of Italian Law, provided for distance contracts.

2. PARTIES OF DISTANCE SALE CONTRACT

The website riobijoux.com, to which the sites www.riobijoux.it and  www.riobijoux.eu are linked, too, is designed to sell items on the  Internet and is overseen by Mr. GIANLUCA GRASSI.

RIO BIJOUX is a sole proprietorship, the headquarters of which is at 39, Via S. Ambrogio  23888 LA VALLETTA BRIANZA (LC) – ITALY, its representative is Mr. Gianluca Grassi, acting as sole trader, Tax code 03534110139  and   registration number of Chamber of Commerce corresponding to T. Code.  GRSGLC62R05F205N.

3.     PRODUCTS

The products are shown on the website with photos taken with great care, but some alterations of colours and images  could take place while loading them on the site riobijoux.com, with the exception of the  description of the products  of which  characteristics such as weight, shape, colour and material of the product, are shown RIO BIJOUX cannot be considered responsible for incidental incongruities. The items offered by RIO BIJOUX to the customers are available as long as stores last. RIO BIJOUX  is up to RB to decide if missing items should be replaced or if new ones would take up. Hence, riobijoux.com doesn’t answer under no circumstances to keep the products on sale for a  period settled in advance. In the event a product shown as available, is out of stock (on the contrary) the customer will be informed with email or by telephone in order to decide if replace it with another item, remove from the order or cancel the order. Every complaint of the buyer about the order or delivery of an item not available will be considered groundless. If the products delivered are not the ones ordered, the Buyer must inform the Seller within  48 hours since delivery. the Buyer will use our email or the telephone number to inform. The buyer in Italy or EU shall give back the wrong product to RIO BIJOUX .. Grassi Gianluca Via S. Ambrogio, 39, 23888 LA VALLETTA BRIANZA – ITALY. The forwarding charges will be at the Seller’s expenses .The Seller will have to send the replaced product once he gets the returned product to his expense. This clause falls if the wrong product is not returned to the Seller in right conditions, packaging and/or original wrapping included

4. CONCLUSION OF  SALE CONTRACT

The order sent by the Buyer is binding  to the Seller only if the processing of order has been carried out and completed correctly. The sale is  considered arranged when the Buyer receives the confirmation of order. The sale contract will be binding and valid once the SALE and PRIVACY TERMS  are accepted and they will be sent again with a copy by riobijoux.com attached to the order confirmation e-mail. RIO BIJOUX reserves the right to refuse or cancel the orders from  the buyer who is insolvent for old orders. The buyer is the only responsible for the data given in filling the information regarding his order. RIO BIJOUX cannot be considered responsible for incidental mistakes  made by the Customer in the procedure of filling his personal information (delivery and invoicing address) and delivery delay or the impossibility to send the ordered products due to these mistakes.

5 RESERVE OF EXECUTION IN CASE OF ITEMS ARE UNAVAILABLE

If the items ordered by the Customer are not available within 30 days since the placement of order, RIO BIJOUX reserves the right to break the sale contract even if the order confirmation email has already been sent. In the event of breaking the contract , RIO BIJOUX will see about sending an immediate notice and refunding the sum already paid for  ordered items

6. PRICE AND ADDITIONAL COSTS

Information about price and  products available on our website,  are subject to  changes without  notice. The price applied will be the one shown on the website  dated as the  order and mentioned on the confirmation order. Prices are shown in Euro (€), tax included  and   cost arisen from order processing included Delivery of products is carried out by RIO BIJOUX by means of  courier DHL both in ITALY   and other countries members of EU. Forwarding expenses are stated in the confirmation purchase order, too. RIO BIJOUX has the option to submit sale terms on the website riobijoux.com  allowing the Customer not pay  forwarding expenses or to facilitate  him/her with promotions. Forwarding will be tracked on the site DHL at the  best convenience of the buyer who engages himself to be at home (or  someone else assigned to  collection) when the deliveries takes place. If the courier could not achieve the delivery due to any reasons caused by the Buyer, the expense of a new delivery will be charged to the Customer himself-. In Italy if the Buyer or  the person charged is not present when the delivery of parcel takes place by courier, the Buyer will be charged for the expense of  storage. If the goods are sent back to the Seller the buyer will be charged for the expense of  return. Forwarding will take place, except any unexpected event, within  24-48 h in  ITALY and  24-72 h for EU.

 

In case of a forwarding abroad, the Buyer will be charged for possible customs duty and formalities, unless opposite  information Lead time in distant places can require a delay of lead time given above. Lead time given refers only to week days , does not include holidays , Saturday and Sunday. Delivery to distant places as well as forwarding of weight  over 3 kilos could entail an increase of given costs. In that case, RIO BIJOUX will contact the customer directly by mail or in another way to inform him of the possible  extra charge The Customer could accept or cancel the order.

 

7.TERMS OF PAYMENT

The price charged  to the Buyer is shown in the order confirmation sent by riobijoux.com. The cost of products can be paid immediately by the  following payment methods

PAYPAL: the Customer can pay by Pay-pal .supported by most credit cards. The order confirmed by the Buyer will be considered valid only after the bank has authorized the transaction. In case of denial by the bank, the order will be automatically cancelled and the Buyer will be informed by email

BANK TRANSFER: The Customer can pay by bank transfer specifying  the  order number  and date of delivery of goods in the  reason. The bank data to which the bank transfer shall be sent  are :GRASSI GIANLUCA IBAN IT24L0305801604100571459328 SWIFT CODE: MICSITM1XXX at CHE BANCA!. Payment should be made within 05 weekdays since the order has been sent . We recommend to send an email to [email protected] attaching copy of the bank transfer  to speed up delivery . Otherwise the order will be carried out by’ RIO BIJOUX once they receive the sum. Failed payment will cancel the sale contract. If the customer is holder of a Tax code , the request of the invoice shall occur contextually to the sending of order by  specific notice by mail to the following address: [email protected], anyway before sending goods. The  mail with the request of the invoice shall include data of the invoice header, the legal address of the seat, Vat number and tax code. RIO BIJOUX will issue the invoice that will be sent to the Customer together with the goods or by email.

8 RIGHT OF TERMINATION

According to the  consumer code, the same person has 14 weekdays since the delivery of items  to  return the unwanted product without giving any reasons. The return must concern  new items in their original packaging with all their possible accessories. Items returned incomplete , damaged or dirty will not be accepted. In case of anomalous or illegal return, RIO BIJOUX has the right to refuse  other orders from the same customer. The Customer will be charged for delivery expense to return the goods Returns must be sent to the following address: RIO BIJOUX owner  Grassi Gianluca, Via S. Ambrogio, 39, 23888 LA VALLETTA BRIANZA – ITALY, to the same address a registered mail A/R within  48h since the goods have been delivered Before proceeding to dispatch the products you must contact [email protected]. In case the order has profited by a free forwarding , the corresponding cost will be detracted from the refund as indicated in the price list. The refund will be paid in 14 weekdays maximum since the receiving of the returned products.

9. GUARANTIES

RIO BIJOUX does not  guarantee any products bought on-line  The buyer accepts the risk of non-conformity of the product. No guarantees is included if the product is used inexpertly carelessly or fin case of fault by the Buyer , as wear and tear or force majeure .

10. LIMITED LIABILITY

RIO BIJOUX will not be responsible for any possible indirect damages . In case RIO BIJOUX,  by way of derogation from the above mentioned disposition , was considered responsible for damages, this  responsibility will be limited to the sale price. Limited liability above mentioned will be applied to all requests of compensation quite apart from the legal reasons of the requests, the requests based on extra-contractual liability included  ; they will not be applied if the producer is responsible. RIO BIJOUX assumes no responsibility for problems caused by uncontrollable events such as accidents, explosions, fires, strikes, earthquakes, floods and other events that could prevent, in whole or in part, to execute the contract on time . RIO BIJOUX will not be liable to any party or third parties for damages, losses and costs incurred as a result of failure to execute the contract for the reasons mentioned above, the customer has the right to the refund of  the price paid. RIOBIJOUX is not responsible for possible fraudulent /illicit use made by third parties of credit cards or other methods of payment when buying products. In fact during the purchasing procedure RIO BIJOUX has never access to the number of the buyer’s credit card  which is  given directly to financier bureau service when a  security connection opens. Besides RIO BIJOUX cannot know the data given to the financier bureau because when the buyer chooses this method of payment, a security connection opens and transmits them directly to the bureau

11 RELEVANT LAW

The contracts agreed upon these terms are regulated by Italian law, hence every reference to other countries ‘law is excluded- No image or written part of the site  riobijoux.com can be used by third parties.
